PTAB Invalidates U.S. Patent Nos. 7,837,100 and 8,905,301 based on Askeladden’s Request

New York, NY — This week, the Patent Trial and Appeal Board (PTAB) issued two final written decisions in related inter partes review (IPR) proceedings involving U.S. Patent No. 7,837,100 (IPR2023-00421) and U.S. Patent No. 8,905,301 (IPR2023-00422) assigned to Liberty Peak Ventures related to authenticating and authorizing debit card transactions. The PTAB concluded the claims of the patents were unpatentable.

 

Askeladden’s Patent Challenge Committee—a group of well-respected experts in the area of patent law—chose to petition the PTAB for review of the two patents as part of the Patent Quality Initiative. In two separate petitions filed in December 2022, Askeladden explained how the claims of the patents were anticipated and rendered obvious by the prior art.

 

The PTAB instituted trial on the asserted grounds on July 19, 2023. Following subsequent briefing and a virtual hearing on May 29, 2024, the PTAB found that Askeladden “has proven by a preponderance of the evidence” that all challenged claims “are unpatentable.”
