PTAB Invalidates Heavily Asserted Patent Challenged by Askeladden

Askeladden L.L.C. successfully invalidated all claims of U.S. Patent No. 7,480,637 in two inter partes review (IPR) proceedings before the Patent Trial and Appeal Board (PTAB). The ’637 patent is generally directed to a customer authentication apparatus used in online transactions. The ’637 patent had been asserted by Jabaa L.L.C. in eight different litigation campaigns against retailers and supermarkets.
Askeladden’s Patent Challenge Committee—a group of well-respected experts in the area of patent law—chose to petition the PTAB for review of the ’637 patent as part of the Patent Quality Initiative. In two separate petitions filed in May 2024, Askeladden explained how all claims of the patent were rendered obvious by the prior art.
The PTAB instituted trials on the asserted grounds of both petitions on December 10, 2024. The PTAB then entered adverse judgment against Jabaa and cancelled the challenged claims, after Jabaa did not contest the asserted grounds in Askeladden’s IPR petitions.

Askeladden formed the Patent Challenge Committee in 2016 to support its ongoing efforts to challenge poor-quality patents it believes are invalid through inter partes review (IPR) proceedings at the United States Patent and Trademark Office. The Patent Challenge Committee decides which poor-quality patents Askeladden challenges using the IPR process and is responsible for conducting IPR proceedings challenging the validity of those patents.
